The intermediate appellate court found that (1) the trial court’s own calculation of the husband’s yearly income did not support a reasonable finding he was able to pay the monthly alimony to her and while meeting his own needs, as contemplated by Md. Code Ann., Fam. Law § 11-106(b)(9) (Supp. 2007); (2) the trial court erred in finding that he potentially could earn $ 100,000 to $ 120,000 annually given that there was no basis for that finding; (3) the indefinite alimony did not automatically continue upon the parties obtaining an absolute divorce, but, instead, all issues of alimony, including the length of any award, had to be decided de novo; and (4) vacation of the trial court’s indefinite alimony award meant the attorney fee award also had to be reconsidered.
